Current Policies of the
Alaska Real Estate Commission

1.

It is the current policy of the Alaska Real Estate Commission that a licensee in Alaska may retain another licensee in a different brokerage to represent or give them specific assistance on properties that they own.

The licensee and brokerage responsible for keeping records to comply with Title 8, such as consumer pamphlets, signed purchased agreements, trust account documentation, etc., would be the licensee giving the specific assistance or representing the licensee.

The client (licensee) who owns the property is required to disclose in writing to the buyer that he/she is licensed to practice real estate in Alaska and file a conflict of interest disclosure, if he/she has retained another licensee to represent them.

It is the current policy of the Commission that it is permissible to pay either a broker or a licensee as a legal entity. (December 2008)

The current opinion of the Alaska Real Estate Commission is that appraisals are not a material fact for disclosure by sellers. They are a subjective opinion of value. Appraisals were considered but excluded by the AREC in the last revision of the residential property transfer disclosure form.
